MESQUITE RETREAT KENNELS
POLICIES AND AGREEMENTS

Please review the policies and information below before your dog’s stay. On this page, you’ll find our full boarding and daycare policies, important details about health, safety, and payments, and the consent form you’ll use to officially register your pet for Mesquite Retreat Kennels.

PAYMENT, BOOKING, AND CANCELLATION POLICY

Owner agrees to pay all fees, rates, and costs incurred during the Pet's stay at the rates in effect at the time of booking.

1 Payment in Full at Booking: To guarantee and secure a reservation, payment for the entire scheduled stay must be paid in full at the time of booking. No reservation will be confirmed, and no kennel space will be held, until full payment is successfully processed. Facility reserves the right to keep a valid credit card on file for any incidentals, extensions, or unexpected fees.

2 72-Hour Cancellation Deadline: Cancellations or modifications to reservations must be requested at least seventy-two (72) hours prior to the scheduled check-in time.
◦ More than 72 Hours Notice: If a cancellation is made more than 72 hours before the scheduled check-in, Owner will receive a 100% full refund to the original form of payment.
◦ Less than 72 Hours Notice: If a cancellation is made less than 72 hours before the scheduled check-in time, or if the Owner fails to show up for the reservation ("No-Show"), Owner will forfeit fifty percent (50%) of the total booking amount. The remaining 50% will be refunded to the original form of payment.

3 Late Pick-Up Fees: The standard check-out time is 7:00 PM. Pets picked up after this time will be assessed an automatic late fee of $25.00, or a half-day boarding rate. If the Pet is not picked up before the close of business for the day, an additional full night's boarding fee will be applied to the card on file, and pickup must be rescheduled for the following business day.

4 Early Departures: If Owner picks up the Pet earlier than the scheduled check-out date, Owner remains financially responsible for the entire reserved stay. No refunds or partial credits will be issued for unused days, as Facility held that kennel space exclusively for the Pet.

5 Collections and Legal Remedies: Any additional unpaid balance incurred during the stay (including veterinary care, extended nights, or food procurement) remaining unpaid thirty (30) days after the missed pickup date will accrue interest at a rate of 1.5% per month (18% per annum) or the maximum allowed by Texas law. Owner agrees to pay all collection costs, attorney fees, and court costs incurred by Facility in retrieving unpaid funds.

MEDICAL EMERGENCY AND VETERINARY CARE AUTHORIZATION

In the event that the Pet becomes ill, injured, or requires medical attention while in the custody of the Facility, Facility will make immediate and reasonable attempts to contact the Owner and the designated Emergency Contact using all provided contact methods.

1 Authorization to Treat: If a medical emergency occurs and the Owner or Emergency Contact cannot be reached immediately, Owner hereby grants Facility full authority to seek veterinary care on behalf of the Pet. This includes transporting the Pet to the Pet's regular veterinarian (if locally available), an emergency veterinary hospital, or a veterinarian of the Facility's choosing.

2 Financial Authorization Limit: Owner authorizes Facility to approve medical diagnostics, treatments, surgeries, and prescriptions necessary to stabilize or save the Pet's life, up to a maximum financial limit of $________ per stay. If life-saving treatment exceeds this amount and the Owner remains unreachable, the Facility and the treating veterinarian are authorized to take necessary measures to relieve acute pain or distress, up to and including humane euthanasia if recommended by a licensed veterinarian to prevent suffering.

3 Liability and Reimbursement: Owner agrees to assume full financial responsibility for any and all veterinary costs, diagnostics, medications, and surgical expenses incurred under this section. Owner agrees to pay veterinary clinic in full for any expenses. An emergency transportation fee of $50.00 per trip will be charged to owner by facility. Owner explicitly releases Facility, its owners, and its employees from any liability associated with vet treatments, outcomes, or decisions made in good faith under veterinary advice.

MEDICATIONS, SUPPLEMENTS, AND DIETARY ALLERGIES

Facility agrees to administer oral, topical, or injectable medications and dietary supplements to the Pet in accordance with the Owner’s written instructions, subject to the following terms:

1 Labeling and Packaging Requirements: All prescription medications must be provided in their original veterinary packaging, clearly displaying a legible label with the Pet’s name, correct dosage, frequency, and the prescribing veterinarian's name. Over-the-counter medications and dietary supplements must be provided in their original manufacturer packaging. Facility will not administer any medication or supplement delivered in unlabeled bags, mixed into loose food, or provided in unidentifiable containers.

2 Declaration of Allergies: Owner must explicitly disclose all known food allergies, environmental allergies, or adverse drug reactions on the intake form. If the Pet requires a strict allergen-free environment or specific handling due to a severe allergy, Owner must provide all necessary hypoallergenic treats and food.

3 Medication Refusal and Liability Waiver: Owner acknowledges that changes in environment and routine can cause a pet to refuse food, treats, or medications. While Facility staff will use reasonable, low-stress techniques to administer medications, Facility will not force-feed medications if the Pet exhibits aggression, severe stress, or repeated spitting up. Facility is not liable for any illness, injury, or adverse health event resulting from the Pet's refusal to take prescribed medication, or from an inaccurate dosage instruction provided by the Owner.

4 Emergency Medication Authority: If the Pet displays symptoms of a life-threatening allergic reaction or an acute medical crisis related to their pre-existing condition, Facility is authorized to administer emergency care or transport the Pet to a veterinary hospital immediately, pursuant to the Medical Emergency section of this Agreement.

FOOD AND NUTRITION REQUIREMENT

To maintain the Pet’s regular diet and prevent gastrointestinal distress, Owner is strictly required to provide a sufficient supply of the Pet’s regular food to last the entire duration of the scheduled stay.

1 Packaging Instructions: Owner agrees to provide all food in an airtight, pest-proof container labeled clearly with the Pet's first and last name. Food must either be pre-portioned into individual meal bags or accompanied by clear, written feeding instructions detailing the exact measurement per feeding (e.g., cups, scoops) and the frequency of feedings per day.

2 Shortage and Extended Stays: Owner agrees to provide at least two (2) extra days' worth of food beyond the scheduled pickup date in the event of an unexpected delay. If the Pet's stay is extended, or if the food provided runs out for any reason, Facility is authorized to purchase the same brand and formula of food if locally available. If the specific food is unavailable, Facility will substitute a high-quality house diet or a sensitive-stomach formula at its sole discretion.

3 Associated Fees: Owner agrees to reimburse Facility for the actual retail cost of any food purchased on behalf of the Pet. Additionally, Owner agrees to pay a $25.00 special-handling and procurement fee per retail trip, plus a house feeding fee of $10.00 per day for each day the Facility must provide food. These charges will be added directly to the final invoice and must be paid in full prior to the Pet's release.

ABANDONMENT POLICY AND FORFEITURE OF OWNERSHIP

If the Pet is not picked up within twenty-four (24) hours of the scheduled pickup date and time specified in this Agreement, and Owner has failed to notify the Facility of a delay, Facility will attempt to contact Owner daily using all provided contact methods.

If Owner fails to respond or retrieve the Pet within three (3) calendar days following the missed pickup date, Facility will send a formal "Notice of Intent to Deem Animal Abandoned" to Owner’s physical address via Certified Mail, Return Receipt Requested.

Owner explicitly agrees that if the Pet is not retrieved and all outstanding balances are not paid in full within ten (10) calendar days of the postmark date of said Certified Mail notice, the Pet shall be deemed legally abandoned. Upon the expiration of this ten-day window, Owner completely and permanently forfeits all rights, title, and ownership of the Pet to the Facility. Facility is hereby authorized to surrender the Pet to a municipal shelter, transfer custody to a 501(c)(3) animal rescue organization, or initiate private adoption proceedings at Facility’s sole discretion.

Owner acknowledges that animal abandonment is a Class A Misdemeanor under Texas Penal Code § 42.092. Owner remains fully liable for all accrued boarding fees, veterinary costs, administrative fees, and legal expenses incurred by Facility until custody of the Pet is formally transferred.

GENERAL LIABILITY WAIVER AND ASSUMPTION OF RISK

Owner explicitly understands and agrees that there are inherent risks associated with boarding, socializing, and caring for domestic pets. Owner voluntarily assumes all risks of injury, illness, disease, or death to the Pet while in the custody of the Facility, subject to the following terms:

1 Contagious Diseases and Viruses: Despite rigorous cleaning protocols, vaccination requirements, and air purification systems, airborne viruses and bacteria can spread in communal environments. Owner acknowledges that Facility is not responsible or liable if the Pet contracts a contagious illness—including, but not limited to, Canine Infectious Respiratory Disease Complex ("Kennel Cough"), Canine Influenza, Canine Parvovirus, or Giardia—during or immediately following their stay.

2 Standard Boarding Risks and Natural Conditions: Owner agrees that Facility is not liable for naturally occurring or stress-induced medical conditions that develop during boarding, including Gastric Dilation-Volvulus ("Bloat"), stress-induced colitis (diarrhea), hotspots, or weight loss due to anxiety. Facility is also not liable for minor, superficial injuries inherent to active pets, such as broken nails, minor scrapes, or raw nose padding from kennel rubbing.

3 Communal Play and Socialization: If Owner permits the Pet to participate in group play or communal socialization, Owner acknowledges that dog behavior can be unpredictable. Even under constant supervision, minor scuffles, scratches, and puncture wounds can occur. Owner waives all claims against Facility for injuries sustained during supervised social play, provided Facility staff acted with reasonable care.

4 Escape and Act of God Provisions: Facility utilizes secure fencing, gated entryways, and professional containment systems. However, in the highly improbable event that the Pet escapes, or is injured due to an "Act of God" (e.g., severe Texas weather, lightning strikes, tornadoes, structural damage from natural disasters), Facility shall not be held civilly liable, provided reasonable emergency protocols were enacted.

5 Indemnification for Third-Party Harm: Owner agrees to indemnify, defend, and hold harmless Facility and its employees from any and all claims, damages, or liabilities (including legal fees) arising out of any property damage, bodily injury, or death caused by the Pet to Facility staff, other boarded animals, or visitors.
